Penal Mediation: Criminal Case Settlement Process based on the Local Customary Wisdom of Dayak Ngaju

Abstract

Penal mediation has been a longtime process of criminal settlement used in the Ngaju Dayak indigenous people in Kalimantan. They used the Belom Bahadat philosophy as a form of reform in the field of criminal procedural law stemmed from the politics of criminal law which makes customary law a part of national criminal law. This article is aimed to analyze the concepts of penal mediation in Indonesia and from the international law perspectives; and the settlement process with Belom Bahadat philosophy-based penal mediation in the Dayak indigenous community and its future use in the national criminal procedural law. This qualitative research applied a sociological juridical approach and utilized primary data obtained from interviews with Dayak traditional elders, secondary data comprising customary peace decisions obtained from Dayak customary institutions, and multidisciplinary approach from international law of penal mediation to uphold the strong concept of penal mediation. The results shown that restorative justice is one of the uniqueness in penal mediation internationally, especially in Germany, Spain, and Indonesia. Furthermore, the use of penal mediation in Dayak community is based on the 96 Articles of the Tumbang Anoi Peace Agreement that has existed since 1894. During a settlement, the penal mediation model applied in the Dayak people can be divided into the Victim Offender Mediation model, as well as Family and Community Group Conferences. Consequently, the formulation of this procedure is expected to be a study material in the renewal of criminal law legislation, specifically the Criminal Procedure law provisions in Indonesia.

Cahya Wulandari, Doctoral Program, Universitas Diponegoro

 

Cahya Wulandari, S.H., M.Hum, is currently pursuinf a Doctoral Program at Universitas Diponegoro, Semarang Indonesia since 2019. The author completed Bachelor of Law at the Universitas Islam Indonesia. Next, she completed her Master of Law at Universitas Gadjah Mada. Currently, she is a lecturer at the Faculty of Law, Universitas Negeri Semarang, and teaches courses focusing on criminal law and legal expertise. During the last 5 years, she has succeeded in conducting 7 legal research, then her experience in the field of Community Service in Semarang City and Berta Village, Banjarnegara Regency, publishing 9 scientific articles in English and 4 in Indonesian, and also publishing 4 book title. Furthermore, she attended oral presentations at 5 international seminars. In addition, she is a member of research in the Member of the Asean Study Center Faculty of law UNNES and the MAHUPIKI Indonesia.

Esmi Warassih Pujirahayu, Universitas Diponegoro

Prof. Dr. Esmi Warassih Pujirahayu, S.H., M.S. is a Lecturer at Universitas Diponegoro, Semarang, Indonesia. She is a Professor at Law and Society. She obtained a bachelor degree of law from Universitas Diponegoro, Indonesia and Master and Doctoral degree from Universitas Airlangga Surabaya, Indonesia.

Edward Omar Sharif Hiariej, Universitas Gadjah Mada

Prof. Dr. Edward Omar Sharif Hiariej (Eddy Hiariej), S.H., M.Hum. (born 10 April 1973) is a professor in Criminal Law at Universitas Gadjah Mada, Yogyakarta. On December 23, 2020, he was inaugurated by President Joko Widodo as Deputy Minister of Law and Human Rights in the Kabinet Indonesia Maju for the 2020-2024 Period. Eddy won the highest degree in academics at a relatively young age, namely at the age of 37 from the Faculty of Law, Universitas Gadjah Mada (UGM).

Muhamad Sayuti Hassan, Universitas Kebangsaan Malaysia

Dr. Muhamad Sayuti Hassan is a Senior Lecturer at the Faculty of Law, Universiti Kebangsaan Malaysia, Selangor, Malaysia. He was seconded to the Parliament of Malaysia as Head of the Research and Library Division from 2016-2019. He also served as Deputy Prosecutor at the Attorney General's Chambers, in 2009 before joining academia. He has an academic background in law, and his research interest is international law and indigenous people, criminal law, and legislative studies.

Juan Anthonio Kambuno, Universitas Negeri Semarang

Juan Anthonio Kambuno is Graduate Law Student from International Undegraduate Program (International Rombel) Faculty of Law, Universitas Negeri Semarang, Indonesia.
