This study aims to analyze the placement of active-duty Indonesian National Army personnel in the civilian sector based on the “constabulary force” theoretical framework proposed by Morriz Janowitz, by examining Law No. 3 of 2025 on Amendments to Law No. 34 of 2004 on the Indonesian National Army and the Civil Service Law. The issue raised is the inconsistency with the principle of civilian supremacy as stipulated in the MPR Decree, which undermines the mandate of reform, due to normative tensions in state administration. Using a normative-juridical approach that examines primary and secondary legal materials through a legislative framework, this study finds that these regulatory changes create the potential for normative ambiguity while indicating a weakening of the principle of civilian supremacy. Consequently, a more comprehensive normative restructuring is required. This is important to ensure that the legal framework remains consistent with the principle of the rule of law and the direction of security sector reform, particularly in maintaining a balance between civilian authority and military professionalism within the framework of a democratic state governed by the rule of law.
