Identifying the “Grey Zone” between Bootleg and Counterfeit on Integrated Circuit Piracy in Indonesia

Abstract

Counterfeit integrated circuit (IC) products have been traded illegally in Indonesia due to the lack of public awareness of IPR and inconsistency in law enforcement. The piracy of IC by irresponsible parties to create fake IC in the form of imitation or pirated goods that imported illegally from China to Indonesia was also apparently a further implication of the issue of global technological war trade. Due to prohibited modifications, there are "grey zone" between the classification of bootleg and counterfeit even though both of them are indeed fake. Bootleg are protected by legitimate brands and industrial designs, so it making them more challenging to prove rather than counterfeit IC that totally ‘copy paste’ the original. To protect integrated circuits in Indonesia, so it is essential to differentiate between counterfeits or bootlegs to enforce the right sanctions. This legal research with normative research method analyzes the differentiation between bootleg and counterfeit IC and legal protection for integrated circuits aspects of bootleg and counterfeit IC in Indonesia through statute and conceptual approaches. This paper recommends the urgency of definitive classification between them to facilitate the proof and imposition of sanctions. Futhermore, the Indonesian Government should revise Law Number 32 Year 2000 by adding regulations regarding ‘priority rights’ so that foreign companies as IC rights owner can also be more easily protected in Indonesia through it. Law enforcement efforts for counterfeit and bootleg IC must also be supported by our commitment to participated in the ‘Anti-Counterfeiting Trade Agreement’.
