The Reform of Halal Product Assurance Supervision to Achieve Legal Certainty

The enactment of the Halal Product Assurance Law (Halal Law) represents Indonesia's commitment to providing protection in the form of legal certainty for its citizens in the consumption of halal products. The existence of Law Number 33 of 2014 concerning Halal Product Assurance as amended by several articles in Law Number 6 of 2023 concerning Job Creation is a manifestation of the state’s role in protecting citizens of Indonesia, 85% of whose 250 million population is Muslim. Hence, supervision of halal products is important in an effort to achieve legal certainty. This study aims to explain the reform of halal product assurance supervision to achieve legal certainty through a juridical-normative method using library materials or secondary data with a comparative approach. The research results show that the Halal Product Assurance (JPH) supervisory framework in Indonesia still faces normative weaknesses in the form of regulatory misalignment, suboptimal clarity of authority and risk-based supervisory procedures, and implementation weaknesses in institutional coordination and data integration. A comparative study with Malaysia shows that supervision must be coordinated, consistent, and capable of sustained enforcement. Therefore, JPH supervisory reform needs to be directed toward a risk-based and digitally integrated model, with clear authority, measurable risk criteria, standardized procedures, and proportional law enforcement and sanctions to strengthen legal certainty and protect Muslim consumers.
