Ms Mirzikinian, who lives at the property with her professional poker player husband Warwick Mirzikinian, was hoping to undergo a $2.6 million rebuild that would see a large section of the home knocked down.

But Woollahra Council originally rejected the proposal as it exceeded the maximum height level of the area.

As well as a new swimming pool and a massive revamp of the property's outdoor space, Ms Mirzikinian also planned to build an adjoining two-storey domicile above the existing building.

Taking the matter to New South Wales Land and Environment Court, she successfully argued the rebuild should be allowed to go ahead.

‘The area of the exceedance does not alter existing solar access to neighbouring properties or open space,' the court's Commissioner Tim Horton found.

Ms Mirzikinian does have to make some concessions however.

The pump for the new swimming pool now has to be located as far as possible from the neighbours' boundaries and the lights on the existing tennis court must be turned off before 9pm.

While it may be good news for the high-flying glamour couple, Mr Mirzikinian is currently facing serious jail time after being charged with dangerous and negligent driving occasioning death following an incident in 2017.

Police allege the poker champion crashed his Tesla into UberEATS rider Julien Trameaux.

The 26-year-old French national died at the scene in Double Bay.

Mr Mirzikinian is set to appear at the Downing Centre Local Court on April 18.
