The Politics Settlement of Land Tenure Conflicts During Jokowi’s Presidency

Abstract

This study was prompted by the high rate of land tenure conflicts in forest areas. In the 2015-2020, a total of 10,000 conflicts were experienced in Indonesia, and a legal approach was used to conduct this normative study. Furthermore, the data collection was through literature and the legal norm method was used for analysis. The results showed that the government reduced the treatment of the conflict by establishing the Directorate of Customary Forest Tenure Conflict Management institutions and legal products of Presidential and Ministerial Regulations. However, the forest land tenure conflict was not resolved during the Joko Widodo administration and was increased by 50 percent from the previous administration of President Susilo Bambang Yudhoyono. Meanwhile, this conflict can be resolved through the role affirmation of State Administrative Law in determining forest areas with legal certainty and justice. The assertion was conducted by enforcing this law against licensing violations and building integrated conflict resolution in creating legal certainty and equity.

I Gusti Ayu Ketut Rachmi Handayani, Faculty of Law, Universitas Sebelas Maret

I Gusti Ayu Ketut Rachmi Handayani Born in Jakarta on October 8, 1972, has been a Professor of State Administrative Law  at the Faculty of Law, Universitas Sebelas Maret, Indonesia since 2016 and Dean (2019-Current). Previously, she had served as Deputy Dean II of the Faculty of Law UNS and Head of the Administrative Law Department of the Faculty of Law UNS. He also served as Secretary of the Environmental Science Study Program at the Faculty of Law UNS (2008-2012). Experience testing and teaching in a number of PTN/PTS, including: Faculty of Law UGM, Faculty of Law UII, Faculty of Law Unissula, Faculty of Law Unisri Surakarta, STIE Kartasura, STIE Trianadra, STIE AUB Surakarta. Completed his Doctorate in Law at UGM Yogyakarta (2004), Masters of Management at UGM Yogyakarta (1997), Bachelor of Law UNS (1995) and has participated in the Comparative Study on Environmental Law at The National University of Singapore (2003). Became the Committee of Experts on the Environment at the Ministry of Development of Disadvantaged Regions (2007). Professor Ayu has been working in the field of HAN and the Environment for a long time. A number of his research and writings, both written alone and with others, have a lot to do with HAN and the Environment. His inaugural speech on November 26, 2016 was entitled "Meneguhkan Eksistensi dan Peranan Hukum Administrasi Negara dalam Penyelesaian Konflik Tenurial Kawasan Hutan di Indonesia Guna Menciptakan Kepastian Hukum dan Keadilan" (Strengthening the Existence and Role of State Administrative Law in Resolving Forest Tenure Conflicts in Indonesia to Create Legal Certainty and Justice). In particular, it represents the idea of the role of Administrative Law in overcoming tenure conflicts in Indonesia.

Lego Karjoko, Faculty of Law, Universitas Sebelas Maret

Lego Karjoko is a Professor at the Faculty of Law, Universitas Sebelas Maret, Indonesia. His area of expertise concerning Agrarian Law. Abdul Kadir Jaelani, Faculty of Law, Universitas Sebelas Maret

Abdul Kadir Jaelani is a Lecturer at the Faculty of Law, Universitas Sebelas Maret, Indonesia. His area of expertise concerning Tourism Law, Administrative Law, and Constitutional Law. Jaco Barkhuizen, Department of Criminology and Criminal Justice, University of Limpopo

Jaco Barkhuizen is currently Head and full Professor in the department of Criminology at the University of Limpopo, South Africa. Masters research was on South African serial killers and the title of his dissertation is:” An exploration of the intra psychic development and personality structure of serial killers through the use of psychometric testing". He was awarded the prestigious Japanese Monbukagakusho Scholarship. His doctoral focus was on: “Sexual Molestation on Public Transportation-A Victimological Approach”. Some of his publications such as The Nature and Extent Of Bullying: A Case Study of Students From a South African University (Journal of African Education, 2022), The Urgency of Restorative Justice on Medical Dispute Resolution in Indonesia (AL-IHKAM: Jurnal Hukum & Pranata Sosial, 2021), and On the criminal justice agency, research and the future direction of Criminological Sciences (Just Africa, 2021).
