Legalization of Medical Marijuana in Indonesia from the Human Rights Perspectives: Lessons Learned from Three ASEAN Countries

Abstract

Marijuana (cannabis) as a therapeutic medication has been used and recognized as part of the health system in several countries. In contrast, marijuana in Indonesia is classified as a class I narcotic under Law Number 35 of 2009 on Narcotics, which is prohibited and cannot be used as medication. However, a detailed examination of the Narcotics Act reveals some loopholes and ambiguities that could be exploited to legalize marijuana as a medication to cure certain illnesses. The present study employs normative legal research, specifically a statutory approach, to justify using marijuana for medical purposes. In addition, a legal comparative method is also used in this study to analyze the use of medical marijuana in three ASEAN countries: Thailand, Malaysia, and Singapore. Despite having a reputation for having highly stringent regulations on narcotics, Indonesia can benefit from the experiences of other ASEAN nations, such as Singapore and Malaysia, who have legalized medical marijuana. This consideration is prompted by the fact that certain individuals have shared positive outcomes from using ‘illegal’ medical marijuana as a form of health treatment. However, it is disheartening to note that these individuals have also had to witness the unfortunate loss of their loved ones and, in some cases, face legal consequences such as imprisonment. Conducting comprehensive research on the use of medicinal marijuana in Indonesia is crucial to upholding the citizens' right to health, as the right to health is a significant component of human rights.

Endang Wahyati Yustina, Faculty of Law and Communication, Soegijapranata Catholic University

Endang Wahyati Yustina was born in Salatiga-Indonesia, in 1959. She was the graduated bachelor of law, from Law Faculty, Diponegoro University, Semarang-Indonesia, in 1983. a graduated master of law, from Post Graduate Program, Indonesia University, Jakarta-Indonesia, in 1991, and a graduated doctor of law, from Post Graduate Program, Parahyangan University, Bandung-Indonesia, in 2010. She has worked as a lecturer at the law faculty Soegijapranata Catholic University of Semarang, since 1984 until now, also teaches in the Master of Health Law at the same university. She supports the course of administrative law and health law, is also a guest lecturer at several universities, state and private steeper for health law course. The scientific work in the form of books, Recognize of Hospital Law (Bandung, Indonesia: Keni Media press, 2012), Other titles that are Legal Entities Hospital (After the enactment of Law No. 44 of the Hospital), published by Soegijapranata Catholic University Press, Semarang, Indonesia, in 2016. She frequent speaker or resource person at various national forums, regional and local, especially in the discussion of the legal aspects of Health. She is also active in organizations engaged in the development of health law in Indonesia.

Marcella Elwina Simandjuntak, Faculty of Law and Communication, Soegijapranata Catholic University

Marcella E. Simandjuntak was born in Jakarta, on October 4, 1969. She finished her PhD Program on 2010 at Diponegoro University, Semarang. Recently, she works as a lecturer and acting as a Dean of the Faculty of Law and Communication of Soegijapranata Catholic University. She teaches criminal law, criminology, children protection law, and criminal justice system. She is also one of the designers of an anti-corruption curriculum used throughout Indonesia’s higher education system. In 2016, she attended a higher education training in Massachusetts, Boston. In 2017, she went to Taiwan to be a a visiting lecturer at Tunghai University, Taichung, Taiwan. She has received several research grants from international donor agencies on the themes of peace building, as well as tolerance and inclusiveness in Indonesian pluralistic society. She also teaches at the Master of Heath Law Program at Soegijapranata Catholic University.

Mohamad Nasser, Faculty of Law and Communication, Soegijapranata Catholic University

Muhammad Nasser was born in Gorontalo, 25 Juni 1953. He finished his Doctoral Study at School of Law - Institute of Health Law and Policy, Loyola, University of Chicago on 2004. He teaches at the Master of Heath Law Program at Soegijapranata Catholic University and some private and state university in Indonesia. Recently, he is a chief of the Association of Health Law Lecturer in Indonesia and also acting as a vice president of World Association of Medical Law (WAML). He has been an invited speaker at many seminars and symposiums and has produced many scientific studies in the field of health law.

John D Blum, School of Law, Institute of Health Law, Loyola University of Chicago

John D. Blum is the founding Director of the Beazley Institute for Health Law and Policy and the inaugural holder of the Beazley Chair in Health Law. He has taught a wide number of health law and policy courses, most recently Government Health Policy, Topics in Long Term Care, and Public Health Law. In 2011, he was awarded the Jay Healey Health Law Teachers Award by the American Society of Law, Medicine & Ethics in recognition for his work in the field. Blum is a two-time Fulbright Scholar in Canada and Malaysia respectively. He is widely published in health law and policy areas in both the legal and health science literature. Over the years, Professor Blum has been very active in the American Health Lawyers Association and the Health Law Section of the American Bar Association and has been a lecturer at universities in North America, Europe, and Asia.
