Protection of Indonesian Migrant Workers in China: The Government's Role and Legal Aspects

Abstract

This study seeks to examine the model of government accountability for protecting Indonesian migrant workers in China. The expected goal of this research is to make a positive contribution to the legal protection system for Indonesian migrant workers in China that is in harmony with justice and can create a sense of peace and security for Indonesian migrant workers in China. This research was carried out with an empirical juridical approach by analyzing primary data by searching for data by going directly to the field and then analyzing it with legal materials, especially primary legal materials and secondary legal materials. Data observation will be carried out using field studies connected with the subject matter studied. The findings and novelties in this study indicate that migrant workers are often objects of human rights violations, such as not getting guaranteed rights and placements when the migrant workers go abroad through illegal labor suppliers. Especially in this case, the crew from Indonesia works on the Chinese ship, the Longxing Ship. This study concludes that problems related to migrant workers must get full attention and protection from the Government because it concerns the safety of Indonesian citizens. Therefore, in this case, the Tegal Regency Manpower and Transmigration Office, the Government must provide full protection to Indonesian migrant workers. In particular are crew members from Indonesia who work on Chinese ships.

Tri Sulistiyono, Faculty of Law, Universitas Negeri Semarang

Tri Sulistiyono, was born in Semarang. Is a PNS Lecturer at the Universitas Negeri Semarang. Joined Universitas Negeri Semarang as a PNS Lecturer since March 01, 2000. His last education was at the Strata 2 (S2) - (Graduated June 23, 2008). As a PNS Lecturer with the position of Lector (Vice Dean III), he is in charge of the main subjects of labor law. He has carried out several research and community service in the last eight years, including " Legal Protection to Child Labour: The Effectiveness of National Criminal Law and International Law Instrument (A Case Study of Indonesia and China) (2020)" and "Accelerating the Establishment of Legal Awareness of Children of the Pantura Family of Tegal Regency (Perspective of the Character of the Children of the Next Generation of the Nation)."

Pratama Herry Herlambang, born in Jakarta. Is a PNS Lecturer at the Universitas Negeri Semarang, joined Universitas Negeri Semarang as a PNS Lecturer since 01 April 2015. His last education was at Strata 2 (S2) - (Graduated April 03, 2012). As a PNS Lecturer with the position of Expert Assistant, in charge of the main subjects of PTUN, Employment Law. He has carried out several research and community service in the last eight years, including "Juridical Review of the Pattern of Work Relations Between Workers and Companies in the Semarang Bus Rapid Transit Transport Mode (2019)", "The Model of Employment Social Security Protection for Non-Wage Recipient Workers in Semarang City (2017)" and "Community Partnership Program with Fishermen with Conservation and Legal Insights in Kedung District, Jepara Regency (2018)".

Safari Dwi Chandra, Faculty of Law, Universitas Negeri Semarang

Safari Dwi Chandra was born in Jepara Regency. He is an international class student of the 2019 Faculty of Law at Universitas Negeri Semarang. He is currently studying in his Junior year. He has conducted research with his team with the title of legal protection for children as asylum seekers and transboundary refugees.

Moch Fahmi Abdulaziz, Shanghai University of Sport

Moch Fahmi Abdulaziz is a Phd Student at Shanghai University of Sport, China.  Moch Fahmi Abdulaziz was born in Kendal, Indonesia in 1989. He is an assistant professor at department of Physical Education, Universitas Negeri Semarang, Indonesia. He is also a doctoral student in Shanghai University of Sport from the department of Physical Education and Sports Training (2020-2023). He completed his master's degree at Univeritas Negeri Semarang from the department of Sport Education (2014). Current research interest: socio-cultural, socio-economic, parental factors, religion, and the impact on children's physical activity during COVID-19 period.
