Rejection of Former Shia Community in Sampang Perspective on Human Rights Law: Discourse of Religious Rights and Freedom in Indonesia

Abstract

Tajul Muluk and 274 former Shia have not been able to return to their hometowns in Sampang District, even though they have pledged repentance to return to Sunni teachings on November 5, 2020. The formulated research problems consisted of: first, what was the position of former Shia adherents in Sampang District based on the perspective of rights and freedom of religion in Indonesia? And second, what was the form of violation of the right to freedom of religion in the case of community rejection of former Shia in Sampang District? This research utilizes empirical legal research methods combined with sociological and anthropological approaches. The research results concluded: First, the existence of former Shia adherents as refugees should be treated as a violation of the constitutional mandate of Indonesia which forbids acts of violence and violations of religious rights and freedoms, of all Indonesian citizens. Second that they were accused of embracing a deviant religious sect, is evidence to their religious minority status; and third the expulsion of the former Shia adherents was a violation of the right to freedom of religion. which had been regulated in the constitution, laws, and regulations under the constitution and the spirit of the Indonesian nation.

Mukhlis, born in Pamekasan, 28 October 1975, completed his Bachelor of Laws at the Faculty of Law, Trunojoyo University of Madura and Master of Laws at the Faculty of Law, Brawijaya University. Currently, the author is a lecturer at Trunojoyo University Madura.

Raphael D. Jackson-Ortiz, University of Miami School of Law

Raphael Daoud Jackson-Ortiz, born in Brooklyn, New York 19 September 1979, completed his undergraduate education in International Relations at Florida International University. He completed his Masters of Library and Information Science at the University of South Florida, and his Juris Doctor at the Interamerican University School of Law in San Juan Puerto Rico, where he graduated Summa Cum Laude. Currently, the author is a Librarian Assistant Professor at the University of Miami School of Law.

Evis Garunja, has completed her doctoral studies in Public Law (2010-2013) at the University of Pavia, Italy. The subject of her thesis is focused on the comparative Administrative Law between Albania and Italy in the area of Social Services Legislation, especially on social protection, health, education and family. She has attended university studies at the Aleksandër Xhuvani University, Elbasan/Albania, LLM at Bologna University/Italy in "International Lawyers". More than 15 years, worked as a lawyer in Human Rights. Part of different experts bodies of national and International NGO on policies and studies. Part time Professor in different private and public universities in Albania from 2004. Till 2015 full time professor of Comparative Public Law in the Public university of Alessander Moisiu Durres/Albania.

Paul Atagamen Aidonojie, Faculty of Law, Edo State University Uzairue

Paul Atagamen Aidonojie, is a lecturer at the Faculty of Law, Edo State University Uzairue, Nigeria. He completed his Ph.D in Law at the University of Ilorin, Nigeria. Several papers have been published in journals focusing on the areas of Revenue Law, Edo State ACJL, Virtual Marriage & x-ray of Nigerian Family Law and Civil Unrest in Nigeria.
