Abstract

Indonesia’s standing as a Muslim-friendly destination has fluctuated in recent Global Muslim Travel Index editions, signalling that its competitiveness in halal tourism can no longer be assumed. This places halal product assurance and certification at the centre of governance, yet the literature treats certification chiefly as a matter of consumer behaviour and business performance, leaving its legal dimension underexplored. This study examines three questions: how halal certification under the Halal Product Assurance Law (Law No. 33 of 2014 as amended by Law No. 6 of 2023) can be optimised to guarantee the halal status of products supporting halal tourism; how certifying halal tourism operates as a marker of competitiveness; and how far Indonesia’s regulation aligns with international standards and the needs of halal tourists. Employing a normative legal method with statutory, conceptual, and comparative approaches, it analyses primary legal materials, including the Halal Product Assurance Law as amended, the Tourism Law, Government Regulation No. 42 of 2024, and the Codex and OIC/SMIIC standards, alongside indexed scholarship. The findings show mandatory certification functions as a legal instrument of consumer protection, though its value depends on transparency and facilitation for small enterprises rather than enforcement alone. As a marker of competitiveness, certifying halal tourism sustains the wider ecosystem beyond food and advances relevant Sustainable Development Goals. Its international alignment, however, remains incomplete: despite SMIIC membership and bilateral mutual-recognition arrangements, full harmonisation is unrealised. The study concludes that harmonising national and international standards simultaneously protects Muslim travellers and strengthens Indonesia’s competitiveness.
