Domestic Violence Law and Maqāṣid al-Syarī’ah in Protecting Families from Psychological Violence

Abstract

This study aims to reconstruct protection against psychological violence under Article 7 of the Domestic Violence Eradication Law through the perspective of Maqāṣid al-Syarī‘ah to strengthen legal certainty and improve victim protection. The study is motivated by the vague indicators of psychological violence, which weaken evidentiary standards and create inconsistent law enforcement. This research employs normative legal research using statutory and conceptual approaches analyzed descriptively and analytically. The findings show that psychological violence produces multidimensional impacts on the objectives of Maqāṣid al-Syarī‘ah. At the level of ḍarūriyyāt, it harms life through mental disorders, weakens intellect through cognitive distortion, disrupts religion through spiritual crises, damages lineage through psychological trauma, and reduces economic stability. At the level of ḥājiyyāt, it causes emotional distress and impairs social functioning, while at the level of taḥsīniyyāt, it degrades ethics, morality, and family relationships. Conversely, stronger psychological protection supports mental stability, religious observance, intellectual functioning, generational resilience, economic productivity, and harmonious family relations. This study confirms that the integration of Article 7 of the Domestic Violence Law with Maqāṣid al-Syarī‘ah strengthens psychological protection through preventive, repressive, and restorative approaches oriented toward public welfare and the protection of human dignity. The novelty of this research lies in integrating positive legal norms with Maqāṣid al-Syarī‘ah to formulate a comprehensive psychological protection model.

  • Iffaty Nasyi’ah, Universitas Islam Negeri Maulana Malik Ibrahim Malang

    Iffaty Nasyiah is a lecturer at the Faculty of Sharia, Universitas Islam Negeri Maulana Malik Ibrahim Malang, with Scopus ID 57223859836. She teaches in the Islamic Family Law, Sharia Economic Law, and Constitutional Law study programs at the Faculty of Sharia UIN Malang. Her academic and research interests include Islamic family law, sharia economic law, gender, the protection of women and children, maqāṣid al-sharī‘ah, and issues of social justice in contemporary Islamic law. In addition to teaching activities, she is also actively involved in research and scientific publications in national and international journals focusing on the development of Islamic law that is responsive to the dynamics of modern society. She is also currently in the final stage of completing her doctoral promotion examination.

  • Muhammad Nasrulloh, Universitas Islam Negeri Maulana Malik Ibrahim Malang

    Muhammad Nasrulloh is a doctoral student in the Islamic Family Law Program at Universitas Islam Negeri Maulana Malik Ibrahim Malang. In addition to pursuing his doctoral studies, he is actively involved in teaching activities at the Faculty of Sharia, UIN Maulana Malik Ibrahim Malang, and Ma’had Aly Zamachsyari Malang. In the academic field, he actively writes and publishes scholarly works in the form of books and journal articles. His research interests include Islamic family law, Islamic legal reform, maqāṣid al-sharī‘ah, gender, the protection of women and children, marriage law, and the dynamics of contemporary Islamic law in Indonesia.     Zummy Humairoh is a student in the Fiqh and Uṣūl al-Fiqh Program with a specialization in Fiqh al-Mar’ah at Ma'had Aly Al-Zamachsyari. She actively engages in the study of Islamic law, particularly in the fields of fiqh, uṣūl al-fiqh, women’s jurisprudence, maqāṣid al-sharī‘ah, Islamic family law, and contemporary issues related to the protection of women and the dynamics of Islamic law in Indonesia. In addition to her academic activities, she is also involved in scholarly writing and the development of Islamic studies grounded in both classical Islamic scholarship (turāth) and contemporary approaches to Islamic legal thought.

  • Fakhruddin Fakhruddin, Universitas Islam Negeri Maulana Malik Ibrahim Malang

    Prof. Dr. Fakhruddin, M.HI. is a professor in the field of Sharia Economic Law at the Faculty of Sharia, Universitas Islam Negeri Maulana Malik Ibrahim Malang, who actively teaches at both the Faculty of Sharia and the postgraduate program of UIN Malang. His expertise includes sharia business law, fiqh muamalah, Islamic financial institutions, sharia economic dispute resolution, and the development of contemporary Islamic economic regulations based on maqāṣid al-sharī‘ah. In addition to teaching, he is also recognized for his strong academic track record through various research projects, scientific publications, national and international seminars, as well as contributions to the development of institutions and studies in sharia economic law in Indonesia. His academic contributions have positioned him as one of the prominent scholars in the development of contemporary Islamic economic and legal studies.

  • Rafeah Saidon, Universiti Teknologi MARA (UiTM)

    Assoc. Prof. Dr. Rafeah Saidon is an academic and lecturer at Universiti Teknologi MARA, particularly at the Academy of Contemporary Islamic Studies (ACIS). She has a strong academic background in the fields of contemporary Islamic studies, Islamic family law, Islamic philanthropy, sharia legal aid, maqāṣid al-sharī‘ah, and social welfare development based on Islamic values. Throughout her academic career, she has served as the Head of Postgraduate Studies at ACIS UiTM and has been actively involved in the development of academic programs and postgraduate research supervision.
