Restorative Justice Principles in Law Enforcement and Democracy in Indonesia

Abstract

Indonesian legal system has not yet adopted the concept and method of restorative justice; therefore, substantial justice for the Indonesian people has not yet been reflected in legal enforcement in the Pancasila democracy system. The research aims to elaborate on the existence of restorative justice in the criminal justice system, which supports the process of democracy in Indonesia. Normative research is used to establish the aim of the research by using secondary data and primary, secondary, and tertiary legal resources. The urgency of this article is to capture how the legal enforcer is using restorative justice. The findings and conclusion of the research determined that restorative justice is based on legal and cultural values in the society, which gave a conventional resolution that fulfils justice. The application of restorative justice is constructed through standard procedures based on the system theory approach, which accommodates all roles and functions of the criminal justice system elements. Therefore, legitimacy, legality, responsibility, and supervision are warranted philosophically, juridically, and sociologically. As a result, implementing the concept of restorative justice in the criminal justice system is a choice for the strategy in politics of law. Restorative justice will support the law enforcement in Indonesia as required in order to create democracy in Indonesia based on Pancasila and Constitution of 1945.

Sukardi Sukardi, Faculty of Law, Universitas Nasional

Sukardi is a Criminal Law Lecturer at the Faculty of Law, National University of Jakarta, Indonesia. In addition to teaching duties, currently he also serves as an Investigator at the Police Criminal Investigation Agency; Forensic Auditor at Indonesian Professional Certification Institute by obtaining Certified Forensic Auditor (CFrA); as a teacher and internal trainer of the Indonesian National Police, received a certificate as a trainer for Financial Criminal Investigation performed by trainer of the Indonesian National Police and monitored by Politeiaacademie (police academy of the Netherlands) (CFCI) April 2012, September 2012 and April 2013 respectively; He has been an International Journal Reviewer at the International Journal of Criminology and Sociology, Lifescience Global Canada in 2021. He has also served as an Advisor to the Australian Study Center of the National University since 2021. Sukardi obtained his Bachelor of Laws degree (Bachelor of Law/SH) in November 2002 from the Manokwari College of Law (Papua). In October 2004, he received his Master of Humanities (M.Hum) in Business Law from Atma Jaya University, Jogjakarta. Finally, Sukardi obtained his Doctor of Law (Dr) degree at the Faculty of Law, Hasanuddin University Makassar, Indonesia in September 2014.

Hadi Rahmat Purnama, Faculty of Law, Vrije Universiteit

Hadi Rahmat Purnama is External PhD Researcher at Faculty of Law, Vrije Universiteit, Amsterdam. He obtained LPDP Scholarship in 2016. He is also a Lecturer at Faculty of Law, University of Indonesia since 2004. He teaches at International Law Department in several courses such as Public International Law, Air and Space Law, General Agreement on Tariff and Trade (GATT 1994), Law and Human Rights, International Trade Dispute Settlement and Law of the Seas. He is the Chair of Executive Board of Human Rights Centre and the Chairperson of Centre of International Law Study at Faculty of Law, Universitas Indonesia. He actives in regional level as Convener of Southeast Asia Human Rights Study Network (SEAHRN) and member of ASEAN University Network –Human Rights Education, which promote and develop human rights in Southeast Asia. He previously worked as Trade Lawyer for Indonesia Trade Assistance Project (ITAP) under the auspices of United States Agency for International Development (USAID), which cover a range of trade law matters including Dispute Settlement, Trade Remedies, Free Trade Agreement and Domestic Trade Issues which related to World Trade Organization (WTO). As a lecturer for Law and Human Rights, he gave various training on International Humanitarian Law, Human Rights to Police, Judges, Attorney and Prison Guard. Mr. Purnama was educated in both Indonesia and United States of America. He received his undergraduate degree in law LL.B (Sarjana Hukum) from the Faculty of Law, Universitas Indonesia in 2002 and earned his Master of Law (LL.M) degree from Washington College of Law, American University at Washington, D.C., in 2004 by obtaining Scholarship from USAID. Currently he is completing his research PhD at Vrije Universiteit, Amsterdam in the Netherlands with scholarship from LPDP, Ministry of Finance Republic of Indonesia.
