Ecological Sustainability from a Legal Philosophy Perspective

Abstract

Gustav Radbruch made a fundamental contribution to legal thought, by suggesting the framework of legal justice, legal benefit, and legal certainty as the main purposes of law. This framework is widely accepted and still serves as a basis for thinking about questions of legal interpretation and the problems of legal positivism. This article argues that Radbruch’s framework falls short of addressing legal issues related to the threats of ecological crisis. Looking at legal theory and legal practice, we propose to add “sustainability” as a meta-value to Radbruch’s ideals of the legal system.

Widodo Dwi Putro, Faculty of Law, Universitas Mataram

Widodo Dwi Putro is currently a senior lecturer at the Faculty of Law, University of Mataram in Indonesia. He received his  bachelor's degree from University of Mataram in 1997, a master's degree from University of Brawijaya in 2000 and PhD  degree from the  Faculty of Law, University of Indonesia in 2011. Widodo published a number of papers in preferred journals, contributed chapters in books, and newspapers. He also participated in a range of forums on legal research with Van Vollenhoven Institute, Leiden University - The Netherlands, Indonesian Judicial Commission, World Wildlife Fund, and others. His area of interests  are philosophy of law, legal theory,  and agrarian law. His works include, among other things “Kritik Terhadap Paradigma Positivisme Hukum” (Critique of the Legal Positivism Paradigm) in 2011, and “Penelitian Sosio Legal: Perlindungan Pembeli Beritikad Baik Dalam Pluralisme Jual Beli Tanah” (Socio-Legal Research: Protection of Good-Faith Buyers in Pluralism, Purchasing and Selling Land) in 2021, and so forth.

Adriaan W. Bedner, Faculty of Law, Universiteit Leiden

Adriaan Bedner is KITLV professor (by special appointment) of Law and Society in Indonesia and Head of Department of the Van Vollenhoven Institute for Law, Governance and Society. Adriaan’s research has a focus on access to justice, legal reasoning, family law and land law – in particular in Indonesia. This has led to publications on a wide variety of subjects, ranging from administrative courts and environmental litigation to human rights promotion in marriage law regimes and Indonesian legal education. He has supervised numerous PhD students and taught many courses at Leiden Law School and Leiden University College, including 'Law and Governance in Asia', 'Political and Economic Foundations of Law' and 'Making Human Rights Work'. Adriaan has been involved in many research and legal education projects in Indonesia, sponsored among others by the Royal Dutch Academy of Sciences, the Dutch Research Council, the Dutch Department of Foreign Affairs and NUFFIC. He is Chair of the Board of the International Institute of Asian Studies, editor of Routledge’s Book Series Law, Development and Globalization, and a member of the Working Group on Legal Co-operation Indonesia-Netherlands.
