The Practice of Money Politics in General Elections from The Perspective of Pancasila Democracy Principles

Abstract

This study aims to analyze the practice of money politics in the implementation of general elections in Indonesia and examine it from the perspective of the principles of Pancasila democracy. Money politics is a form of election violation that often occurs and has the potential to damage the quality of democracy because it can influence voter choices irrationally and create inequality in political competition. This study uses a normative juridical research method with a legislative approach, a conceptual approach, and a historical approach. The legal materials used include primary legal materials in the form of laws and regulations, specifically Law Number 7 of 2017 concerning General Elections, as well as secondary legal materials in the form of literature and relevant research results. The results of the study indicate that the practice of money politics has been regulated and prohibited in various provisions of the Election Law, such as Articles 278, 280, 284, 286, 515, and 523. However, law enforcement against the practice of money politics still faces various obstacles, including limited regulations regarding the subject of the perpetrator, weak supervision, and low public legal awareness. Therefore, strengthened regulations, increased oversight by election organizers, and active public participation are needed to prevent and address the practice of vote buying and ensure honest, fair, and democratic elections in accordance with the principles of Pancasila democracy
