Speedy Trial in Election Crimes in Indonesia: Between Judicial Efficiency and Evidentiary Integrity

Abstract

Speedy trials in regional election criminal cases are essential for maintaining democratic integrity, but they raise concerns about balancing efficiency with substantive justice. This study examines the implications of implementing speedy trial principles on evidence quality, access to justice, human rights protection, and judicial system integrity through normative legal analysis of primary sources. The research reveals that accelerated judicial processes create tensions between procedural speed and thoroughness, potentially compromising the examination of evidence, disadvantaging resource-limited defendants, and risking due process violations. The findings demonstrate that expedited timelines may undermine comprehensive legal reasoning in judicial decisions. A balanced framework is essential to achieve both procedural efficiency and substantive justice in electoral criminal proceedings.

  • Riezka Eka Mayasari, Faculty of Law, Universitas Sembilanbelas November Kolaka

    She was born in Makassar on May 23, 1984. Currently, she holds dual responsibilities as a lecturer and Dean at the Faculty of Law, University of Sembilanbelas November Kolaka. In her capacity as an academic and faculty leader, Riezka not only actively participates in the teaching process but also consistently produces scholarly writings. Her research focus encompasses various aspects of civil law, particularly in the fields of contract design, agrarian law, mining law, and business law. Her leadership as Dean is also crucial in enhancing the academic quality and reputation of the Faculty of Law at the University of Sembilanbelas November Kolaka, making it a high-quality and competitive institution for legal education.

  • La Ode Awal Sakti, Faculty of Law, Universitas Sembilanbelas November Kolaka

    He was born in Raha on October 1, 1991. He is currently dedicated to serving as a lecturer at the Faculty of Law, Sembilanbelas November University, Kolaka. As a criminal law expert, he is not only an active teacher but also a productive writer and publisher of scientific articles in the field of law. His primary areas of expertise include criminal law, criminal procedure law, general offences, election offenses, and the juvenile justice system. Additionally, La Ode Awal Sakti regularly participates in various activities as a resource person, providing insights and a deep understanding of criminal law issues. Through his academic role and practical involvement, he makes significant contributions to the development of legal science, particularly in enriching the knowledge of criminal law issues among students and the public.

  • Siti Hudzaifah Miftahul Jannah, Faculty of Law, Universitas Sembilanbelas November Kolaka

    She was born in Barru on July 20, 1995, and currently serves as a lecturer in criminal law at the Faculty of Law, November 19 University, Kolaka. In addition to her academic role as a teacher, she is also active in writing scholarly articles and contributing to social activities through her volunteer work with the Friends of Witnesses and Victims (SSK) in the South Sulawesi community. Her research focuses on criminal law, criminal procedural law, victimology, and the protection of the rights of women and children, which are her primary areas of interest in teaching and social activities.

  • Yahyanto, Faculty of Law, Universitas Sembilanbelas November Kolaka

    He was born in Wundulako on June 6, 1982, is currently serving as a lecturer at the Faculty of Law at Sembilanbelas November University in Kolaka. He is recognized for his active involvement in teaching and his prolific writing of scientific articles. Previously, his dedication to the institution was demonstrated by his role as Dean of the Faculty of Law at USN Kolaka. His expertise is diverse, encompassing criminal law, criminal procedure law, environmental criminal law, corruption offenses, and mining offenses. In addition to his role in academia, Yahyanto is also a prominent figure in law enforcement, frequently providing expert testimony in various criminal cases.
