Diversion in Child Sexual Violence Cases: A Comparative Study of Indonesia and Norway

Abstract

This study examines the implementation of diversion in child sexual violence cases in Southeast Sulawesi, Indonesia, and compares it with restorative justice practices in Norway. Despite the growing adoption of diversion under Law No. 11 of 2012 on the Juvenile Criminal Justice System, its application in sexual violence cases remains controversial and inconsistent. Using a qualitative approach based on interviews and document analysis, this study finds that diversion practices in Indonesia are constrained by victims' consent, socio-cultural factors, and limited institutional capacity. At the same time, Norway demonstrates a more structured, welfare-oriented restorative model. The study highlights the need for clearer guidelines and stronger victim protection mechanisms to ensure a balanced approach to justice.

    Lecturer with the functional position of Lecturer in the Law Study Program, Universitas Sembilanbelas November Kolaka, Southeast Sulawesi. His research articles include applications of restorative justice at the prosecutor's level and in domestic violence cases. Through community service, the author also provides legal counseling and assistance to underprivileged communities in accessing justice. His article titled "Criminological Review of Juvenile Delinquency in Society Due to Parenting in the Gen Z Era" was published in the Journal of Law and Legal Reform, Vol. 6, Issue 1 (2025), 481-498. The writer is a Bachelor of Laws (S1) from the University of 19 November Kolaka (2011) and a Master of Laws (S2) from Wijaya Kusuma University Surabaya (2014).

The author is interested in public policy issues, including violence against women and children.  In 2023, he wrote a background on the importance of public policy in a book chapter titled "Public Policy: Theory, Formulation and Application." In 2024, write Sexuality and Gender in the book chapter Protecting Women From Violence (Perspectives, Implementation, and Challenges). Since 2023, she has also held a mandate in the Task Force for the Prevention and Handling of Sexual Violence at Sembilanbelas November Kolaka University, one of her duties being to socialize students and lecturers on the prevention of sexual violence at her workplace.  Bachelor (S1) of Social Sciences at Universitas Haluoleo (2009), and Master of Science (S2) at Universitas Hasanuddin (2013).
