Abstract

This study examines the mechanisms for resolving environmental crimes practiced by the Dayak Ngaju indigenous community in Central Kalimantan, focusing on the Huma Betang principle as the foundation of their social and ecological values. Using a normative legal approach and the theoretical frameworks of De Voy and Leopold Pospíšil, the research reveals that Dayak Ngaju customary law is not only socially legitimate but also represents a form of living law that effectively maintains environmental balance and resolves conflicts through collective consensus. The Huma Betang principle, emphasizing communal solidarity, harmony with nature, and deliberation-based decision-making, serves as the cornerstone for both the imposition of sanctions and ecological restoration. The findings underscore the importance of recognizing customary law within the framework of legal pluralism and highlight the need to integrate indigenous legal systems into the national legal order to strengthen ecological justice and enhance the effectiveness of environmental law enforcement.

  • Nuredy Irwansyah Putra, Doctoral Students in Law, Faculty of Law, Universitas Gadjah Mada

    He completed his primary education at Helvetia Public Elementary School (SDN Helvetia) Medan in 1990, followed by Medan Public Junior High School 16 (SMPN 16 Medan), from which he graduated in 1993. Secondary education was pursued at Medan Public Senior High School 11 (SMAN 11 Medan) and completed in 1996. The Bachelor of Law (S1) degree was obtained from Universitas Sumatera Utara in 2005, and the Master of Law (S2) degree was completed at Universitas Diponegoro in 2011. This educational background forms a strong foundation for the development of academic and professional competence in the field of law.

  • Marcus Priyo Gunarto, Faculty of Law, Universitas Gadjah Mada

    He is a Professor of Criminal Law at the Faculty of Law, Universitas Gadjah Mada (UGM), specializing in criminal law, criminal procedure, and criminology. As a senior academic and legal scholar, he has been actively involved in teaching, research, and public discussions on criminal law reform, victimology, and the modernization of Indonesia’s criminal justice system. His works emphasize the integration of cultural, ethical, and comparative perspectives to shape a more humane and effective framework for criminal law enforcement.
